Procedures For Reporting a NCAA Rules Violation:
A. Reporting a Violation - Any individual (e.g., athletics department staff member, student-athlete, university employee, representative of the university's athletics interest, members of the community) shall report an alleged, rumored or suspected violation. The individual may report the alleged, rumored or suspected verbally or in writing.
B. To Whom Shall an Alleged, Rumored or Suspected Violation be Reported To - If an a alleged, rumored or suspected violation is communicated to any athletic department staff member, the staff member is duty bound to notify the Office of NCAA Compliance in a timely manner. Individuals other than athletic department staff members may report an alleged violation to any or all of the following persons:

C. Conducting an Investigation of an Alleged Violation - The Associate Athletics Director for NCAA Compliance is responsible for conducting investigations. The Director of Athletics is responsible for overseeing institutional investigations. The Faculty Athletics Representative will be informed of all potential major violations and will receive notice of violations secondary in nature. Associate Athletics Director for NCAA Compliance or the Director of Athletics may request the assistance of the Faculty Athletics Representative to conduct or assist in the conduct of an investigation.
Associate Athletics Director for NCAA Compliance shall maintain a written record of all alleged violations. The record shall consist of the following:
1. Date that the alleged violation was reported to Associate Athletics Director for NCAA Compliance and who reported the violation.
2. Detailed summary of the nature of the alleged violations, including the names of all persons involved.
3. Chronology of actions taken by the University in the investigation of the alleged violation.
4. Rational for concluding whether the allegations was or was not determined to be violation of NCAA legislation
5. If a violation has occurred, Associate Athletics Director for NCAA Compliance will keep a file copy of the report of the violation and subsequent correspondences with the NCAA and the MWC staff. Copies of the self-report will be sent to the following:
a). Faculty Athletics Representative
b). Director of Athletics
c). President & CEO
d). SWA/ Associate Athletics Director
e). Sr. Associate Athletics Director
f). Mountain West Conference Staff
g). Staff Member(s) Involved
The Associate Athletics Director for NCAA Compliance will maintain the reports of alleged violations for a period of six years. Records and reports of confirmed violations will be maintained in the office's permanent files.
D. Finding a Violation Occurred - The Associate Athletics Director for NCAA Compliance is responsible for determining that a violation occurred whenever the preponderance of the evidence, considered as a whole establishes the occurrence of the violation. It shall be the responsibility of the Associate Athletics Director for NCAA Compliance in assessing the evidence to determine what weight and credibility will be given to it. The Associate Athletics Director for NCAA Compliance may request the assistance of the Faculty Athletics Representative to conduct or assist in the conduct of an investigation into an alleged violation and/or assist in determining that a violation has occurred.
